Someone is selling my free software :(

Post by Joakim Christiansen »

Someone bought JLC's Internet TV from this page:
http://www.satellite-tv-4-pc.com/
What should I do?

This is his the page who linked to his page:
http://inlandempire.craigslist.org/

He is running two pages, whois returned this:
http://www.eqtotalsecrets.com/
Baldwin, Craig, eqtotalsecrets@yahoo.com
6730 4th Ave #131
Sacramento, California 95817
United States
Phone: 916-457-7594

http://satellite-tv-4-pc.com/
Baldwin, Craig, webmaster@eqtotalsecrets.com
2050 State University Drive
East #110
Sacramento, California 95819
United States
Phone: 916-548-1081

Looks like it may be this guy:
http://www.imdb.com/name/nm0049878/
http://en.wikipedia.org/wiki/Craig_Baldwin

Purchase receipt:
http://www.myhome.no/whatever/Output.pdf

Hahahahaha, this guy is going DOWN!!!

And it stands clearly in my licence:
2. You must not take any charges for the distribution of JLC's Internet TV.

Is it possible for me to sue him? How should I do that when I'm from Norway and he is from USA?

From the wikipedia:
Baldwin has also emerged as somewhat of an activist for the re-evaluation of copyright and intellectual property laws. He says that “Collage is the contemporary art. It is the most definitive. Yet it runs absolutely against copyright laws. There are certain assumptions about the usage of other people’s material in order to make money from it.
The e-mail I got:
I didn't know your product was free. I paid $24.95 (USD) for it from Craig Baldwin who is selling it on Craigslist.org. .
I hope you gave him permission to sell it!.

HIre an american lawyer if you can afford it.

That guy probably pretty loaded though. He could make that lawsuit last years and bankrupt you in most cases.

Uhmmmm..... How do you know it's your software? There are no screen shots to compare it to... It's also a lot larger than yours, a search with uTorrent finds files of 12 MB or more while yours is less than 200 Kb.

But, assuming it is your software...

Since your software is free, it probably wouldn't pay to hire an attorney to sue him.

But what you might be able to do is contact the hosting services that he has his web site on, and explain the situation requesting that they shut down his web site.

Another approach is to contact ClickBank and advise them of what he's doing, they can't shut down his web site but they sure can stop taking payments for him.

Since that purchase proof also shows PayPal, I'd contact them too.

You could even go so far as to contact this guy directly, though that probably won't do you much good.

I got a email from a guy who had bought it from that page, I don't think he got any reason to lie.

He seams to be exactly like those pages that offer 'free mp3 download with software' and drives people to download freeware p2p... because they are not exactly selling the software but something like 'expertise advice' (they give you some advice on how to do it and charge for that)... yes, its tricky but maybe they are using some tinny text to do that.

Reading his page... its not exactly saying nowhere that he sells the software... no matter he talks about some download.

BTW, can you provide some link to your own software? (Sounds nice!!)

He takes money for letting people download my software, I call that selling others software, and just see this quote from the page:
Just purchase the software, download and you get 3000+ Stations Forever for FREE

You have to contact some attorney... but some average (not the best but the cheapest) attorney in US cost about $400 PER HOUR!!

You have to send some e mail to the guy that is seeling to make sure its your software and maybe you can make a deal with him.

Advice: consult an expert immediately!
Take one in Norway, doesn't have to cost that much money.
At least you will know what the legal possibilities are.

That would be the right first step to take.

I don't know who to contact actually, but I should be able to sue this guy for much money acutally.
I have contacted the host for his page and the page he used for selling my software, I asked them both to keep any evidence I can use against him.
This guy has is name all over the place, should be easy to nail him!

Good point, and how would he know to contact you unless this other guy didn't even bother to remove any copyright or writen by notices in the program.
Joakim Christiansen wrote:What are you talking about?!
He calls the program "Satellite TV for PC", so I did a search of several torrent sites and found several torrents for the program, most were about 12 MB (some were larger), your site says that your download is 191 KB.

Example search

I'm not questioning whether the program he is selling is yours or not, I'm more inclined to believe you than him. Just trying to understand how the determination was made since there seems to be very little to go on to connect the two as the same program.

The guy didn't bother to hack it out of my program, I guess he's a noob at such things

There are 5 other pages just like his too (but now owned by him), the net is full of scam like this, and everybody calls it "Satellite TV".
Of course you'll find much files with that name.

The guy who bought it from that page and somehow found my page, I guess he just clicked the link inside the program.
No need to discuss this anymore it's obvious, just as he stated in the e-mail he sendt! :P

I don't think it's that guy, LOL. You're basically saying that a 54-year-old
filmmaker from Sacramento is selling your software? I think you have the
wrong Craig, mate.
I compile using 5.31 (x86) on Win 7 Ultimate (64-bit).

Nothing to laugh at, yes it think it's him!
Why else would the address and name match?!
And he is a AMATURE film maker btw.

From wiki:
Craig Baldwin was born in Oakland, California and grew up in nearby Sacramento
Domain owner address:
Sacramento, California 95819
See the connection?
