Personally I wouldn't categorise this as spyware, but as it says on the site, a monitoring software.

Oh I didnt meant to say spymon is spyware :? - It is a monitoring tool and the customer might be agreeing with this. So what they do with it is not really the developer's (or is it?, it shouldnt... as if someone kills a guy on the street with a ford car, the parents of the guy would sue ford motor company!!!?, no way..).

I agree dagcrack.
A victims family can't, or shouldn't be able to sue a weapons manufacturer because some kills someone with their weapons. One good thing about people is our free will. Well, sometimes it's a good thing ;)
