regarding legel of selling, i think its legel!
the program manages streams and for managing streams and index them you can charge since its our nature to seek for media, this is kidna orginizer of streaming.
and thats can be a good reason for selling it.

second if you want the program to work damn good you should program a button that auto updates broken links!
lets say a user uses your program and he gets upset there are few broken links.. should do a button that its intention is to update the broken links in a working one.
i recommand you do on the server side a program that checks valid links each 10 min if your going commercial.

another suggestion, put a DOWNLOAD plugins button for people who dont use or know realplayer.

I was a little delayed in fully attempting to use this thing. It runs, but doesnt work for me. Complains about security settings for active X. I tried changing them, they work fine with everything else, just not this. I know the problems probably on my end but i can't get it to work.

I am still thinking about the legal question about this kind of software.
What SFSxOI wrote was rather interesting ... but it is according to US law
only. The special thing of this kind of software is however that it uses
"data" from sources round the world.

From my naive understanding what is right or wrong it might cause a prob-
lem if you release a program such as this one with preinstalled URL to
download. Because some TV station might claim that potential buyers
might just buy the product because of the preselected programs.

Furthermore, imagine a website from a small local TV station which uses
their stream as a advertising tool to get more visits on their site (page hits).
With the existence of such a tool there won't be an increase of visitors but
the increase of bandwidth still remains (=which means cost for the TV
station).


In my eyes a possible way I could imagine would be to release and sell
such a program barely without any preinstalled URL-streams. So the buyer
just pays for the program itself.

Then you might offer an install-list with URL-streams which can be read by
the program as freeware.

Any comment on this idea concerning legal aspects :roll:

I'm not a legal person, i had just asked the question of one of our leagl staff after seeing some posts about it. I think the thing about the fees is this; the one time fee to purchase the software (the money you pay for the product - in this case the software product) needs to be just that - just like you walked into a software store and purchased it, you pay for it and don't have to keep paying for it to keep using it to receive the streams - if you had to keep paying for the software to keep receiving the streams then that would be the same as charging a fee for the streams which are free to begin with and amounts to re-distributing the stream which would not be legal. The reason it would be legal to charge a one time fee for the software its self would be bacause its not considered to have been used for its intended purpose until after you buy it so the one time payment would be legal. Actually we are confusing terms here, your not paying a 'fee' for the software when you buy it, you are purchasing it just like any other product. So if after you purchase it there are no fees then due for its continued use, the use of the software would be legal to receive the free material, but if there is a fee then its re-distributing the material which would not be legal because the material is free to begin with, in short the software company would be charging you for something that was free to begin with that they did not own and thats not legal. Its not legal to sell something you dont own.

To borrow a part of your example, it would not be legal for example for us to take regular local off the air broadcast TV thats avaiable to anyone with a television and then sell a box that people hook up to their televisions to get the same off air broadcast and charge money for people to use the box each month. that would be re-distribution and would not be legal because they don't own the free material to begin with. Once again, its not legal to sell something you dont own.

And no, before you think that "Well cable TV does the same thing" - actually they don't, the fee you pay for cable TV each month is for the content the cable company provides, in the US you don't get charged for local off the air broadcasts that anyone can get with a regular television without cable TV hooked up. If seems like your getting charged for it because the fee the cable company charges doesn't break it out like that because they just charge a flat fee for their content without the local broadcast TV.
